Terms of Use

1. About BOSQUE
BOSQUE (“BOSQUE,” “we,” “us”), operated by Bosque LLC, is a curated media publication and creative agency at bosquestyle.com that features homes, spaces, and design across Montecito, Santa Barbara, and the surrounding California coast. Features are editorial presentations. Where the platform passes along an inquiry, it introduces you to the independent listing agents, owners, or managers connected to a featured property. Bosque LLC is not a real estate brokerage, is not a party to any purchase, rental, or stay, and does not process payments, hold deposits, or manage property in connection with the platform. Any transaction that follows an introduction is arranged solely between the parties to it.
2. Changes to These Terms
We may update these Terms from time to time. The current version will always be posted on this page with its effective date. Continued use of the platform after changes are posted constitutes acceptance of the updated Terms.
3. Features and Introductions
BOSQUE features properties editorially and passes inquiries, such as showing requests or stay inquiries, to the property’s listing agent, owner, or manager. Any resulting arrangement, including its price, dates, terms, and any agreement governing it, is made solely between you and that party. Confirm all terms directly with them before committing to anything. BOSQUE makes no promise that any inquiry will receive a response or that any property is available.
4. Acknowledgment and Release
By inquiring about a property discovered through BOSQUE, you acknowledge that each property is represented, owned, or operated by an independent third party; that BOSQUE has not inspected, verified, or certified any property, listing detail, license, or permit; and that any showing, stay, purchase, or other arrangement, and any agreement governing it, is solely between you and that party. To the fullest extent permitted by law, you release and hold harmless Bosque LLC and its owner, employees, and agents from any claim arising out of or relating to such an arrangement, including property conditions, accuracy of descriptions, cancellations, refunds, and personal injury or property damage.
5. Owner and Agent Responsibility
Property owners, listing agents, and managers are solely responsible for their properties and listings, including legal compliance, the accuracy of information provided to BOSQUE, property safety, and communication with interested parties. BOSQUE does not verify licensing, permits, insurance, or property conditions, and featuring a property is not an endorsement or guarantee of any kind. Compensation owed to BOSQUE for sponsored features or other services is governed by separate written agreements.
6. Use of Site Content
All content on bosquestyle.com and BOSQUE’s related channels, including photography, video, text, and design, is owned by or licensed to BOSQUE and is provided for personal, non-commercial use only. No content may be reproduced, distributed, or used commercially without our prior written consent.
7. Submissions
By submitting materials to BOSQUE, including property submissions, photos, and messages (excluding personal contact information), you grant Bosque LLC a royalty-free, perpetual, irrevocable license to use, reproduce, edit, and display those materials in connection with the platform and its marketing. You represent that you have the rights to any material you submit, including photography.
8. Prohibited Use
You agree not to submit false inquiries or fraudulent information; scrape, crawl, or harvest content or data by automated means; interfere with the operation of the site; attempt unauthorized access to any system or account; or upload malicious code.
9. Disclaimers and Limitation of Liability
The platform and all content are provided “as is” and “as available,” without warranties of any kind, express or implied. To the fullest extent permitted by law, Bosque LLC is not liable for errors in listings or features; the condition of any property; the acts or omissions of any owner, agent, manager, or guest; failed or disputed transactions between third parties; or any indirect, incidental, special, or consequential damages. If BOSQUE is nonetheless found liable, total aggregate liability is capped at one hundred dollars ($100 USD).
10. Force Majeure
BOSQUE is not responsible for failures or interruptions caused by events beyond reasonable control, including natural disasters, fire, weather, utility or infrastructure failures, government action, or public health events.
11. Indemnification
You agree to indemnify and hold harmless Bosque LLC and its owner, employees, and agents from claims, damages, and expenses (including reasonable attorneys’ fees) arising from your use of the platform, any arrangement with a third party introduced through the platform, or your violation of these Terms.
12. Governing Law and Venue
These Terms are governed by the laws of the State of California. Any dispute arising under these Terms will be resolved exclusively in the state or federal courts located in Santa Barbara County, California.
13. Relationship of the Parties
Nothing in these Terms creates a partnership, joint venture, agency, or employment relationship between BOSQUE and any owner, agent, manager, or visitor. Featured parties are independent third parties, and BOSQUE is not responsible for their acts or omissions.
14. Severability
If any provision of these Terms is held invalid or unenforceable, the remaining provisions continue in full force.
